Texas Tech professor Mark Mackenzie isn't just judging Elena Kagan's performance on the hot seat. He's looking at the bigger picture and says so far she's doing what every other recent nominee has done -- dodge tough questions with guarded answers.
By Mackenzie's account this leaves the senators, and Americans, in the dark about how nominees truly interpret the Constitution.
He says the last nominee to speak candidly about their position on the Constitution was Robert Bork, and he wasn't confirmed.
